Please read these terms carefully before using Roam.

Who we are and acceptance

Roam is owned and operated by Stonkd Inc. ("STONKD," "we," "our," or "us"). By accessing or using Roam, the website at goplayroam.com, and related services (collectively, the "Platform"), you ("you" or "your") are contracting with Stonkd Inc. and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Platform. Continued use of the Platform constitutes acceptance of these Terms.

Eligibility and parents

Roam may be played by children only with the permission of a parent, legal guardian, or other responsible adult, who must accept these Terms and our Privacy Policy on the child's behalf. That adult is responsible for the child's use of the Platform. Purchases, including Roam Plus, may be made only by an adult of legal age who can form a binding contract.

Accounts

Roam creates an account automatically on your device. You are responsible for keeping your device and any backup email secure and for all activity under your account, and for providing accurate information. We may suspend or remove accounts involved in fraud, cheating, abuse, or illegal activity, including multiple accounts used to exploit rewards.

Licence and ownership

We grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to use the Platform for personal, non-commercial purposes, subject to these Terms. All rights, title, and interest in the Platform — including the software, Creets, artwork, designs, databases, and trademarks — are owned by STONKD or its licensors. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the Platform. Bucks, Creets, and items have no cash value and cannot be sold, traded for money, or transferred.

Acceptable use

You agree not to:

• use the Platform unlawfully or engage in fraud, spam, or manipulation;
• infringe anyone's intellectual property;
• hack, probe, scrape, introduce malware, spoof your location, or otherwise interfere with the Platform's security or integrity;
• trespass, enter unsafe or closed areas, or play while driving — always stay aware of your surroundings;
• share your account with others or transfer it to a third party.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds for Roam Plus are governed by Paddle's Buyer Terms and Paddle's Refund Policy. Roam Plus renews monthly until cancelled; you can cancel any time in Settings and keep Plus until the end of the paid period. To request a refund within 30 days, see our Refund Policy.

Service availability

The Platform is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, error-free, or that locations, encounters, or features will always be available. To the fullest extent permitted by law, STONKD disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

STONKD shall not be liable for indirect, incidental, special, or consequential damages, or any loss of profits, data, or goodwill. STONKD's aggregate liability shall not exceed the amount you paid to STONKD in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury where the law does not allow it.

Indemnity

You agree to defend and hold harmless STONKD and its affiliates from claims arising from your breach of these Terms or your use of the Platform.

Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations. Upon termination, your right to use the Platform ends. Your data is handled as described in our Privacy Policy.

Third-party services

The Platform uses or links to third-party services, such as Google Maps and Paddle. We are not responsible for third-party services, which you use at your own risk and subject to their own terms.

Changes

We may modify these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

Privacy

Your use of the Platform is governed by our Privacy Policy. If you disagree with it, you must stop using the Platform.

Governing law and disputes

These Terms are governed by the laws of Rhode Island. Disputes may be resolved through binding arbitration or the courts of Rhode Island. To the fullest extent permitted by law, disputes will be resolved only on an individual basis and not as part of a class, consolidated, or representative action. If this waiver is found unenforceable, the entire arbitration agreement will be null and void.

General

No waiver of rights is implied by non-enforcement. If any provision is unenforceable, the remainder remains valid. These Terms and our Privacy Policy are the full agreement between you and STONKD.
